The Tax Equity and Fiscal Responsibility Act (TEFRA) allows states to provide basic Medicaid coverage to children who need
special care, but whose parents choose to take care of them at home. TEFRA is a category of eligibility for Medicaid
coverage. It is supplemental insurance for parents with children with special needs.
To be eligible for Medicaid coverage through TEFRA, a child must:
- Be age 18 or under
- Be receiving appropriate care at home, at a cost less than care in an institution
- Meet Supplemental Security Income (SSI) childhood disability requirements
- US Citizenship
- Have low income and resources without counting those of the parents
- Meet an institutional level of care. The three levels of care are intermediate care for the mentally retarded (ICF/MR), nursing facility (i.e. skilled or intermediate) and hospital. Meeting level of care does not mean your child be institutionalized.
